Welcome to The Resting View Guesthouse Pty Ltd. (hereinafter referred to as "we," "us," or "our"). By booking and staying at our guesthouse, you agree to be bound by the following terms and conditions. Please read them carefully before making a booking.
1. Acceptance of Terms
By making a reservation, staying at our guesthouse, or using our services, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, you should not book or stay at our guesthouse.
2. Booking and Payment
- Reservations: All bookings are subject to availability. A booking is confirmed once you receive a booking confirmation from us, either via email or phone.
- Deposit: Payment in full of the total booking amount will be required at the time of reservation.
- Payment Methods: We accept the following payment methods: credit/debit card, EFT, cash. Any additional charges incurred during your stay must be settled before departure.
- Rates: Rates are subject to change without prior notice. However, confirmed bookings will be honoured at the rate at the time of confirmation.
3. Cancellation and Refunds
- Cancellation by Guest: Cancellations must be made in writing (info@therestingviewguesthouse.co.za) and received by us at least days before the arrival date for a full refund. Cancellation Policy: Any Cancellation done within 3 days will result in a determination fee of the 1st day stay amount. Cancellations done with 48 hours will result in the first two days amount. Cancellation done within 24 hours will result in 3 days amount being held back. Cancellations made within 7days of arrival may incur a cancellation fee or result in the forfeiture of your deposit.
- No-Show: If you fail to arrive without prior notice, the full booking amount may be charged, and no refund will be provided.
- Cancellation by Us: We reserve the right to cancel your booking in exceptional circumstances, including force majeure events or unforeseen circumstances. In such cases, we will provide a full refund of any deposits paid but will not be liable for any other compensation.
4. Check-in and Check-out
- Check-in Time: Check-in is available from 2pm to 9pm.
Please inform us of your estimated arrival time.
- Check-out Time: Check-out must be completed by
10am on the day of departure. Late check-outs may incur additional charges unless otherwise agreed upon in advance.
- Early Check-in / Late Check-out: Subject to availability, early check-ins and late check-outs may be arranged, but additional charges may apply.
5. House Rules
To ensure a comfortable stay for all guests, we request compliance with the following house rules:
- No Smoking: Smoking is not permitted in any indoor areas of the guesthouse. Designated smoking areas may be provided outside.
- No Pets: Pets are not allowed unless specifically agreed upon in advance.
- Noise Levels: Guests are expected to maintain respectful noise levels, particularly during quiet hours from 8pm until 8am
- Respect for Property: Guests are responsible for any damage to guesthouse property, and the cost of repairs or replacement may be charged to the guest.
- Visitors: Non-registered visitors are not permitted to stay overnight or day visits unless prior arrangements have been made with management. We are a shared guesthouse and space are therefor limited.
6. Liability and Guest Responsibilities
- Guest Responsibility: Guests are responsible for their personal belongings and valuables. We are not liable for any loss, theft, or damage to personal property unless such loss is due to our negligence.
- Damage and Indemnity: You agree to indemnify and hold The Resting View Guesthouse harmless from any liability for damages, injury, or losses caused to our property during your stay, whether caused by you, your guests, or your visitors.
- Personal Injury: We will not be held liable for any injuries, accidents, or incidents that occur on our property unless they are directly caused by our negligence.
7. Force Majeure
We shall not be held responsible for any failure to fulfill our obligations under these Terms of Service due to unforeseen circumstances or events beyond our control, including but not limited to natural disasters, strikes, war, acts of terrorism, or government regulations.
8. Privacy Policy
Your personal information will be collected and processed in accordance with our Privacy Policy, which is available on our website or upon request. By booking and staying at our guesthouse, you consent to the processing of your personal data for the purposes of fulfilling your booking and related guest services.
9. Dispute Resolution
Any disputes arising from your stay at The Resting View Guesthouse or your use of our services shall be resolved in accordance with South African law. In the event of a dispute, both parties agree to first attempt resolution through negotiation or mediation before pursuing formal legal action.
10. Amendments to Terms
We reserve the right to modify or update these Terms of Service at any time without prior notice. The most current version will be available on our website or provided upon request. Continued use of our services after changes to these terms signifies your acceptance of the updated terms.
